The following are the terms and conditions for use of the Three Marketers Inc services provided to you by Three Marketers Inc.
Your use of The Three Marketers Inc’s service(s) signifies your acceptance of The Three Marketers Inc’s terms and conditions of service provision. If you do not wish to be bound by The Three Marketers Inc’s terms and conditions of service provision, you may not use the service(s) offered. It is your responsibility to review these terms from time to time so you will be apprised of any change.
1. Payment Terms:
• A signed proposal and a 50% upfront payment are required to begin the Initial SEO Package. The remaining balance is due within 30 days of project commencement.
• The Monthly SEO Maintenance Package is billed in advance at the start of each month.
• For Pay-Per-Click (PPC) services, setup fees and a deposit equal to two months’ ad budget are required before campaign launch.
• PPC management fees will be billed monthly, based on the amount of clicks delivered, plus applicable management fees.
• Failure to pay within 30 days of invoicing will result in immediate suspension of all services until the account is brought up to date.
2. Forms of Payment:
• We accept cheque, Interac Email Money Transfer, or credit card (credit card payments are limited to a maximum of $2,500).
• Late payments will incur a 2% charge per month on overdue balances.
• NSF cheques will incur a $50 administrative fee.
• If an account is overdue by 60 days, The Three Marketers Inc. reserves the right to pursue collections or take legal action, including but not limited to reporting the outstanding balance to a credit agency.
3. Contract Renewal:
• Contracts automatically renew on a month-to-month basis unless cancelled with proper notice.
• Prices and service options may be subject to change, with a 30-day written notice.
4. Website Modifications & Compliance:
• If the client modifies or redesigns their website, re-optimization fees may apply.
• Clients must notify us in advance of major website changes to avoid disruptions in SEO performance.
• The Three Marketers Inc. is not liable for any ranking drops, loss of traffic, or penalties resulting from unapproved modifications.
5. Cancellation Policy:
• Clients may cancel at any time with a written 30-day notice.
• Each month started is due in full. No pro-rated refunds will be issued for partial months.
• Setup fees are non-refundable under any circumstances.
• If a client cancels and does not retrieve their data or reports within 30 days, all records may be permanently deleted from our system.
6. Service Guarantees & Liabilities:
The Three Marketers Inc. does not guarantee specific rankings or performance metrics on search engines, as results depend on external factors beyond our control. We are not responsible for any penalties, de-indexing, or traffic loss due to:
- Client-initiated website modifications without prior consultation.
- Use of third-party SEO tools, software, or agencies without our knowledge.
- Non-compliance with search engine guidelines (e.g., excessive keyword stuffing, spammy backlinks).
- Search engine algorithm changes or ad platform policy updates.
7. Use of Services & Client Responsibilities
• The client agrees to provide accurate business information, website credentials (if applicable), and necessary materials to facilitate service delivery.
• The client is responsible for reviewing and approving content, ads, and SEO changes within a reasonable timeframe.
• The Three Marketers Inc. is not responsible for delays caused by missing or incomplete information from the client.
8. Confidentiality & Data Protection
• All client information and project details will be handled confidentially.
• The Three Marketers Inc. will not share or sell client data to third parties.
• Clients must not disclose proprietary marketing strategies or reports
provided by The Three Marketers Inc. without permission.
9. Limitation of Liability
• The Three Marketers Inc. is not liable for indirect damages, including loss of revenue, business opportunities, or search engine algorithm changes affecting rankings.
• Services are provided on a best-effort basis, and results may vary depending on industry competition and external factors beyond our control.
10. Force Majeure
• The Three Marketers Inc. is not responsible for delays or service failures due to circumstances beyond our control, such as server outages, natural disasters, cyber-attacks, or regulatory changes affecting search engines or ad platforms.
11. Governing Law
• These Terms & Conditions are governed by the laws of Alberta, Canada.
• Any disputes shall be resolved through arbitration or legal proceedings in Calgary, Alberta.
The Three Marketers Inc. reserves the right to update these Terms & Conditions, service policies, and pricing at any time without prior notice. Clients will be notified of significant changes via email or through an update posted on our website.
